1. Acceptance of Terms

By accessing or using Cruit ("the Service"), a mobile application and platform that connects youth baseball and softball players with coaches, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Cruit is a recruiting platform designed to facilitate connections between youth baseball and softball players (ages 10U through college) and coaches. The Service allows:

  • Players to create profiles, log game statistics, and receive offers from coaches
  • Coaches to discover players through swipe-based browsing, view detailed profiles and statistics, and send tryout and team offers
  • Both parties to communicate and manage recruiting relationships

3. User Accounts and Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to create an account. Users under 18 must have parental or guardian consent to use the Service.

4. User Content and Responsibilities

You are solely responsible for all content you post, upload, or otherwise make available through the Service ("User Content"), including but not limited to:

  • Player profiles, statistics, and game logs
  • Video clips and photographs
  • Messages and communications with other users
  • Team information and offer details

You represent and warrant that:

  • You own or have the necessary rights to all User Content you submit
  • Your User Content is accurate and truthful
  • Your User Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights
  • Your User Content complies with all applicable laws and regulations

5. Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Harass, abuse, threaten, or harm other users
  • Post false, misleading, or fraudulent information
  • Impersonate any person or entity or misrepresent your affiliation
  • Collect or store personal data about other users without permission
  • Use automated systems (bots, scrapers) to access the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service
  • Use the Service to solicit or recruit for purposes unrelated to baseball or softball
  • Share your account credentials with others

6. Offers and Recruiting

Cruit facilitates connections between players and coaches but is not a party to any agreements, offers, or contracts made between users. You acknowledge that:

  • All offers, tryouts, and team invitations are made directly between users
  • Cruit does not verify, endorse, or guarantee the accuracy of user profiles or offers
  • You are responsible for conducting your own due diligence before accepting offers or making commitments
  • Cruit is not responsible for the outcome of any recruiting relationships
  • Any disputes between users must be resolved directly between the parties

7. Intellectual Property

The Service, including its design, features, and functionality, is owned by Cruit and protected by copyright, trademark, and other intellectual property laws. You retain ownership of your User Content but grant Cruit a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of operating and providing the Service.

8. Privacy and Data Security

Your use of the Service is also governed by our Privacy Policy. We use Firebase for secure authentication and data storage. While we implement reasonable security measures, no method of transmission over the internet is 100% secure. You acknowledge that you provide information at your own risk.

9. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice. We do not guarantee that the Service will be available at all times or that it will be free from errors or interruptions. Currently, the Service is available on iOS devices. Android support is planned but not guaranteed.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CRUIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

12. Indemnification

You agree to indemnify, defend, and hold harmless Cruit and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. You may also terminate your account at any time by contacting us or using account deletion features in the app.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Cruit operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cruit regarding the use of the Service and supersede all prior agreements and understandings.
